DMCA & Copyright Policy
How to tell us that something on this site infringes your copyright, what a valid notice has to contain, and how to answer one if it was aimed at your work by mistake.
Our position on copyright
ToolQivo respects the intellectual property of others and expects the same in return. The written content, code, layout and branding on this site are ours. Where we use anything from elsewhere — an icon set, an open-source library, a reference table — it is used under a licence that permits it.
The site does not host user uploads. The tools run in your browser and nothing you process is stored on our servers, so there is no library of visitor-supplied files here for a rights holder to worry about. In practice a copyright complaint about this site will concern our own published text, an image, or an embedded third-party resource.
Sending a takedown notice
If you own a copyright, or are authorised to act for the owner, and you believe material on toolqivo.com infringes it, send a written notice to toolqivo@gmail.com with "DMCA Notice" in the subject line.
To be effective under section 512(c)(3) of the US Digital Millennium Copyright Act, your notice must include all of the following:
- A physical or electronic signature of the copyright owner, or of a person authorised to act on their behalf.
- Identification of the copyrighted work you say has been infringed — or, if several works on this site are covered by one notice, a representative list of them.
- Identification of the material you say is infringing, with enough detail for us to find it. A full URL for each item is what makes this quick.
- Your contact details: name, postal address, telephone number and email address.
- A statement that you have a good-faith belief that the use complained of is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or are authorised to act on the owner's behalf.
An incomplete notice is not ignored, but it cannot be acted on as a formal notice until the missing parts arrive — so it is faster to send everything at once.
What we do when a notice arrives
We acknowledge receipt within 2 working days. Where the notice is valid and the complaint is well founded, the material is removed or disabled promptly, usually well inside a week. We keep a record of the notice and of what we did about it.
If we believe the material is not infringing — because it is licensed, because it is our own work, or because the use is fair — we will say so and explain why rather than simply removing it. Copyright is not a tool for removing accurate criticism or lawful commentary, and we will not treat it as one.
Counter-notice
If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the same address, marked "DMCA Counter-Notice". It must contain:
- Your physical or electronic signature.
- Identification of the material that was removed, and the location it appeared at before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, postal address and telephone number.
- A statement that you consent to the jurisdiction of the federal court for the district in which you live — or, if you are outside the United States, of any judicial district in which we may be found — and that you will accept service of process from the person who filed the original notice.
We will forward a valid counter-notice to the complainant. If they do not tell us within ten business days that they have filed a court action, the material may be restored.
Repeat infringers and false claims
Where any part of this site allows a contribution from outside — a submitted tool suggestion, for example — access for anyone who repeatedly infringes copyright is terminated. Equally, section 512(f) makes it unlawful to knowingly misrepresent that material is infringing. A notice sent in bad faith can make its sender liable for damages and costs, including ours.
If it is our content that has been copied
The tool descriptions, guides and other written content on this site are original work and are protected by copyright. You are welcome to link to any page, quote a short passage with attribution, or point people here. Republishing whole pages, or scraping the site to build a competing catalogue, is not permitted and is pursued through the host, the search engines and the ad networks involved.
